We adopt this notice to comply with the California Consumer Privacy Act of 2018 (CCPA) and any terms defined in the CCPA have the same meaning when used in this Notice. <\/span><\/p>\n<p class=\"p4\"><span class=\"s3\"><b>Information We Collect<\/b><\/span><\/p>\n<p class=\"p3\"><span class=\"s1\">We receive information from our clients, visitors to our websites,<span class=\"Apple-converted-space\">\u00a0 <\/span>and from websites using our TrustedForm service that identifies, relates to, describes, references, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer, household, or device (&#8220;<b>personal information<\/b>&#8220;). For example, from forms you complete or products and services you purchase.<\/span><\/li>\n<li class=\"li3\"><span class=\"s1\">Through the TrustedForm JavaScript code snippet embedded by a website operator on a participating website.<span class=\"Apple-converted-space\">\u00a0 <\/span>Note that we do not operate or otherwise control the sites that implement the TrustedForm Script, so you must consult the relevant site\u2019s privacy policy to determine what specific data points are collected on the forms where our Script is present. <\/span><\/li>\n<\/ul>\n<p class=\"p4\"><span class=\"s3\"><b>Use of Personal Information<\/b><\/span><\/p>\n<p class=\"p2\"><span class=\"s1\">We may use or disclose the personal information we receive for one or more of the following purposes: <\/span><\/p>\n<ul class=\"ul1\">\n<li class=\"li3\"><span class=\"s1\">To fulfill or meet the reason you provided the information. <\/span><\/li>\n<li class=\"li3\"><span class=\"s1\">To provide, support, personalize, and develop our Website and marketing services.<\/span><\/li>\n<li class=\"li3\"><span class=\"s1\">To provide you with support and to respond to your inquiries, including to investigate and address your concerns and monitor and improve our responses.<\/span><\/li>\n<li class=\"li3\"><span class=\"s1\">To deliver content and product and service offerings relevant to your interests, including targeted offers and ads through our Website, third-party sites, and via email or text message (with your consent, where required by law).<\/span><\/li>\n<li class=\"li3\"><span class=\"s1\">For testing, research, analysis, and product development, including to develop and improve our Website, products, and marketing services.<\/span><\/li>\n<li class=\"li3\"><span class=\"s1\">To respond to law enforcement requests and as required by applicable law, court order, or governmental regulations.<\/span><\/li>\n<li class=\"li3\"><span class=\"s1\">As described to you when collecting your personal information or as otherwise set forth in the CCPA.<\/span><\/li>\n<li class=\"li3\"><span class=\"s1\">To independently verify the origin of online sales leads through the use of proprietary JavaScript (\u201cTrustedForm Script\u201d) installed on a web page containing a contact request form (\u201cHosting Page\u201d) on third-party websites. The TrustedForm Script captures what was viewed by the site visitor on the Hosting Page, as well as the site visitor\u2019s real-time interactions with the Hosting Page, for example, clicks, mouse movements, and data inputs. The TrustedForm Script issues a digital certificate (\u201cTrustedForm Certificate\u201d) that contains this information for each site visitor and is passed with each lead collected on the Hosting Page as an additional data field. TrustedForm Certificates automatically expire within 3 days of being issued unless either claimed or having the claiming period extended for a 3 month period by a TrustedForm account holder (the \u201cClaiming Period\u201d). Once a Certificate has expired, it is permanently deleted. By claiming a TrustedForm Certificate, a TrustedForm account holder is able to verify the authenticity of the TrustedForm Certificate, extract the data from the TrustedForm Certificate, and store the TrustedForm Certificate in their TrustedForm account for future reference. Claimed TrustedForm Certificates are stored as long as specified by the TrustedForm account holder.<\/span><\/li>\n<\/ul>\n<p class=\"p2\"><span class=\"s1\">We will not collect additional categories of personal information or use the personal information we collected for materially different, unrelated, or incompatible purposes without providing you notice.<\/span><\/p>\n<p class=\"p4\"><span class=\"s3\"><b>Sharing Personal Information<\/b><\/span><\/p>\n<p class=\"p3\"><span class=\"s1\">We may disclose personal information to a third party for a business purpose. When we disclose personal information for a business purpose, we enter a contract that describes the purpose and requires the recipient to both keep that personal information confidential and not use it for any purpose except performing the contract. <\/span><\/p>\n<p class=\"p3\"><span class=\"s1\">We share personal information with the following categories of third parties: <\/span><\/p>\n<ul class=\"ul1\">\n<li class=\"li3\"><span class=\"s1\">Service providers.<\/span><\/li>\n<\/ul>\n<p class=\"p2\"><span class=\"s1\"><b><i>Disclosures of Personal Information for a Business Purpose<\/i><\/b><\/span><\/p>\n<p class=\"p3\"><span class=\"s1\">In the preceding twelve (12) months, Company has disclosed the following categories of personal information for a business purpose: <\/span><\/p>\n<p class=\"p10\"><span class=\"s1\">Category A: Identifiers.<\/span><\/p>\n<p class=\"p10\"><span class=\"s1\">Category B: California Customer Records personal information categories.<\/span><\/p>\n<p class=\"p11\"><span class=\"s1\">Category C: Protected classification characteristics under California or federal law.<\/span><\/p>\n<p class=\"p11\"><span class=\"s1\">Category D: Commercial information.<\/span><\/p>\n<p class=\"p10\"><span class=\"s1\">Category E: Biometric information.<\/span><\/p>\n<p class=\"p10\"><span class=\"s1\">Category F: Internet or other similar network activity.<\/span><\/p>\n<p class=\"p3\"><span class=\"s1\">We disclose your personal information for a business purpose only to Service Providers and TrustedForm account holders.<\/span><\/p>\n<p class=\"p2\"><span class=\"s1\"><b><i>Sales of Personal Information <\/i><\/b><\/span><\/p>\n<p class=\"p3\"><span class=\"s1\">Company does not sell personal information and, in the preceding twelve (12) months, Company has not sold personal information.<\/span><\/p>\n<p class=\"p4\"><span class=\"s3\"><b>Your Rights and Choices <\/b><\/span><\/p>\n<p class=\"p3\"><span class=\"s1\">The CCPA provides consumers (California residents) with specific rights regarding personal information. This section describes your CCPA rights and explains how to exercise those rights. However, be advised that any personal information provided to us by a client or by a site implementing the TrustedForm Script is solely used by us for the purpose of providing services to such client or site.<\/span><\/p>\n<p class=\"p2\"><span class=\"s1\"><b><i>Access to Specific Information and Data Portability Rights<\/i><\/b><\/span><\/p>\n<p class=\"p3\"><span class=\"s1\">You have the right to request that we disclose certain information to you about our collection and use of your personal information over the past 12 months. Once we receive and confirm your verifiable consumer request (<i>see<\/i> Exercising Access, Data Portability, and Deletion Rights), we will disclose to you:<\/span><\/p>\n<ul class=\"ul1\">\n<li class=\"li3\"><span class=\"s1\">The categories of personal information we collected about you.<\/span><\/li>\n<li class=\"li3\"><span class=\"s1\">The categories of sources for the personal information we collected about you.<\/span><\/li>\n<li class=\"li3\"><span class=\"s1\">Our business or commercial purpose for collecting or selling that personal information.<\/span><\/li>\n<li class=\"li3\"><span class=\"s1\">The categories of third parties with whom we share that personal information.<\/span><\/li>\n<li class=\"li3\"><span class=\"s1\">The specific pieces of personal information we collected about you (also called a data portability request).<\/span><\/li>\n<\/ul>\n<p class=\"p2\"><span class=\"s1\"><b><i>Deletion Request Rights <\/i><\/b><\/span><\/p>\n<p class=\"p3\"><span class=\"s1\">You have the right to request that we delete any of your personal information we collected from you and retained, subject to certain exceptions. Once we receive and confirm your verifiable consumer request (<i>see<\/i> Exercising Access, Data Portability, and Deletion Rights), we will delete (and direct our service providers to delete) your personal information from our records, unless an exception applies. <\/span><\/p>\n<p class=\"p3\"><span class=\"s1\">We may also deny your deletion request if retaining the information is necessary for us, our customers, or our service provider(s) to: <\/span><\/p>\n<ol class=\"ol1\">\n<li class=\"li3\"><span class=\"s1\">Protect against malicious, deceptive, fraudulent, or illegal activity, detect security incidents, or prosecute those responsible for such activities.<\/span><\/li>\n<li class=\"li3\"><span class=\"s1\">Complete the transaction for which we collected the personal information, provide a good or service that you requested, take actions reasonably anticipated within the context of our ongoing business relationship with you, fulfill the terms of a written warranty or product recall conducted in accordance with federal law, or otherwise perform our contract with you.<\/span><\/li>\n<li class=\"li3\"><span class=\"s1\">Debug products to identify and repair errors that impair existing intended functionality.<\/span><\/li>\n<li class=\"li3\"><span class=\"s1\">Exercise free speech, ensure the right of another consumer to exercise their free speech rights, or exercise another right provided for by law.<\/span><\/li>\n<li class=\"li3\"><span class=\"s1\">Comply with the California Electronic Communications Privacy Act (Cal. Penal Code \u00a7 1546 <i>et. seq.<\/i>).<\/span><\/li>\n<li class=\"li3\"><span class=\"s1\">Engage in public or peer-reviewed scientific, historical, or statistical research in the public interest that adheres to all other applicable ethics and privacy laws, when the information&#8217;s deletion may likely render impossible or seriously impair the research&#8217;s achievement, if you previously provided informed consent.<\/span><\/li>\n<li class=\"li3\"><span class=\"s1\">Enable solely internal uses that are reasonably aligned with consumer expectations based on your relationship with us.<\/span><\/li>\n<li class=\"li3\"><span class=\"s1\">Comply with a legal obligation.<\/span><\/li>\n<li class=\"li3\"><span class=\"s1\">Make other internal and lawful uses of that information that are compatible with the context in which you provided it.<\/span><\/li>\n<\/ol>\n<p class=\"p2\"><span class=\"s1\"><b><i>Exercising Access, Data Portability, and Deletion Rights<\/i><\/b><\/span><\/p>\n<p class=\"p3\"><span class=\"s1\">To exercise the access, data portability, and deletion rights described above, please submit a verifiable consumer request to us by either: <\/span><\/p>\n<ul class=\"ul1\">\n<li class=\"li2\"><span class=\"s1\">Emailing us at support@activeprospect.com. <\/span><\/li>\n<li class=\"li2\"><span class=\"s1\">Sending a written request to ActiveProspect, Inc., 4203 Guadalupe Street, Austin, TX 78751.<\/span><\/li>\n<\/ul>\n<p class=\"p3\"><span class=\"s1\">Only you, or someone legally authorized to act on your behalf, may make a verifiable consumer request related to your personal information. You may also make a verifiable consumer request on behalf of your minor child. <\/span><\/p>\n<p class=\"p2\"><span class=\"s1\">You may only make a verifiable consumer request for access or data portability twice within a 12-month period. The verifiable consumer request must:<\/span><\/p>\n<ul class=\"ul1\">\n<li class=\"li3\"><span class=\"s1\">Provide sufficient information that allows us to reasonably verify you are the person about whom we collected personal information or an authorized representative.<\/span><\/li>\n<li class=\"li3\"><span class=\"s1\">Describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it.<\/span><\/li>\n<\/ul>\n<p class=\"p3\"><span class=\"s1\">We cannot respond to your request or provide you with personal information if we cannot verify your identity or authority to make the request and confirm the personal information relates to you. <\/span><\/p>\n<p class=\"p3\"><span class=\"s1\">Making a verifiable consumer request does not require you to create an account with us. <\/span><\/p>\n<p class=\"p3\"><span class=\"s1\">We will only use personal information provided in a verifiable consumer request to verify the requestor&#8217;s identity or authority to make the request. <\/span><\/p>\n<p class=\"p2\"><span class=\"s1\"><b><i>Response Timing and Format<\/i><\/b><\/span><\/p>\n<p class=\"p3\"><span class=\"s1\">We endeavor to respond to a verifiable consumer request within forty-five (45) days of its receipt. If we require more time (up to 90 days), we will inform you of the reason and extension period in writing.<\/span><\/p>\n<p class=\"p3\"><span class=\"s1\">Any disclosures we provide will only cover the 12-month period preceding the verifiable consumer request&#8217;s receipt. The response we provide will also explain the reasons we cannot comply with a request, if applicable. For data portability requests, we will select a format to provide your personal information that is readily useable and should allow you to transmit the information from one entity to another entity without hindrance.<\/span><\/p>\n<p class=\"p3\"><span class=\"s1\">We do not charge a fee to process or respond to your verifiable consumer request unless it is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request. <\/span><\/p>\n<p class=\"p4\"><span class=\"s3\"><b>Non-Discrimination<\/b><\/span><\/p>\n<p class=\"p2\"><span class=\"s1\">We will not discriminate against you for exercising any of your CCPA rights. Unless permitted by the CCPA, we will not:<\/span><\/p>\n<ul class=\"ul1\">\n<li class=\"li3\"><span class=\"s1\">Deny you goods or services.<\/span><\/li>\n<li class=\"li3\"><span class=\"s1\">Charge you different prices or rates for goods or services, including through granting discounts or other benefits, or imposing penalties.<\/span><\/li>\n<li class=\"li3\"><span class=\"s1\">Provide you a different level or quality of goods or services.<\/span><\/li>\n<li class=\"li3\"><span class=\"s1\">Suggest that you may receive a different price or rate for goods or services or a different level or quality of goods or services.<\/span><\/li>\n<\/ul>\n<p class=\"p4\"><span class=\"s3\"><b>Changes to Our Privacy Notice<\/b><\/span><\/p>\n<p class=\"p3\"><span class=\"s1\">We reserve the right to amend this privacy notice at our discretion and at any time.
